1. Berberis regulatory decision
The Canadian Food Inspection Agency (CFIA) has posted a risk management decision document, which provides rationale for proposed next steps for program modernization, and a Notice to Industry that communicates the CFIA's recommendation for movement restrictions for three Japanese barberry cultivars.Key points include:
- A modified option “2” from the original proposed regulation has been determined to be the best course of action.
- Concorde, Royal Cloak, and Tara/Emerald cultivars will be ultimately prohibited and are strongly discouraged from cultivation and trade in Alberta, Saskatchewan, and Manitoba in the interim.
- A set of criteria will be developed in consultation with industry (both grain and ornamental horticulture) to determine appropriate guidelines for allowing and prohibiting cultivars.
2. Development charges for agricultural buildings in Niagara
Landscape Ontario was part of a broad effort in May to maintain the exemption for agricultural buildings from development charges in the Region of Niagara. The final proposed By-Law will be finalized in July, but we did receive a great deal of support from the Development Charges Policy Task Force to maintain our exemption. Further, we look forward to working with OFA and the province to support farm housing and cold frame exemptions.3. Spotted Lanternfly (SLF) – PEST ALERT
Keep watching for egg masses or larval stages of SLF in your spring shipments from the eastern seaboard and look for adults in the nursery over the next months. Excellent images and resources are found on APHIS’s SLF website, as well as the University of Massachusetts Amherst website.
SLF is a serious pest of ornamentals, and we need to keep an eye out for it. Contact Jeanine or Jamie (and your local CFIA office!) if you suspect you have SLF on farm.

Your input will help tabulate a national sum of economic losses incurred, and expected to be incurred due to the prohibition of sales of these three crops to the U.S.
Ontario New Plant Development Committee member appointed to Canadian Plant Breeder's Rights Advisory Committee:
Congratulations to Brad Rooney of Scott's Miracle-Gro for his recent appointment by the Minister Bibeau for a three-year term. Brad is a long-time member of CNLA's New Plant Development Committee and also sits on the Rose Breeding subcommittee. The mandate of this committee is to advise the CFIA Commissioner on the application of the Plant Breeders' Rights Act and Plant Breeders' Rights Regulations.
